Agreement to Terms
In purchasing this program, you agree to these terms of use, which constitute a legally binding agreement made between you, whether personally or on behalf of an entity and Elemental Clarity LLC (EC). This includes access to and use of all other EC property including but not limited to: website, other media forms, media channels, app communities, mobile sites, digital assets. All are subject to modification or change at EC’s discretion. For intellectual property, digital property, and user safety it is required to accept and comply with the Terms of service and use. You agree that by accessing the Site and/or the Products, you have read, understood and agree to be bound by all of these Terms of Use. If you do not agree with all of these terms of Use, then you are expressly prohibited from using the Site and/or the Products and you must discontinue immediately.
The information provided is not intended for distribution or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject EC to any registration requirement within such jurisdiction or country.

Intellectual Property Rights
Unless otherwise indicated, the Site and the Products are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographic and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by EC or licensed to EC. All information, products, and programs purchased are for personal use only.
No part of the Site or the Products and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed or otherwise exploited for any commercial purpose whatsoever.
All products purchased, information purchased, and programs purchased are for personal use only, no commercial use.
Authority to sign
Each party has the authority to enter into this program and to perform all of its obligations under this contract. The party confirms that (1) all registration information submitted will be true, accurate, and complete, (2) the party maintains accuracy of such information (3) the party has the legal capacity to comply with the Terms of service and use (4) the party is at least 18 years of age on purchase (5) the party’s use of the site, products, or programs will not violate any applicable law or regulation.
If the party were to provide any information that is untrue, inaccurate, not current, or incomplete, EC has the right to suspend or terminate the party’s account and refuse any and all current or future use of the Site (or any portion thereof).
Elemental Clarity LLC is a a service provider and makes no representations as to the safety, effectiveness, adequacy, accuracy, availability, prices, ratings, reviews, or legality of any of the information contained on the site or offered through the site. You, the party, understand and agree that the content of the Site does not contain or constitute representations to be reasonably relied upon, and you agree to EC us harmless from any errors, omissions or misrepresentations contained within the Site’s content.
Payments and Fees
When the party submits an online application to EC in offer or program the party is making an offer to join the Site, access the Site, program, and products which if accepted by EC results in a legally binding contract.
The party will be required to purchase or pay a fee to access some of our services, programs, products, and other offers. The party agrees to provide current, complete, and accurate purchase and account information for all purchases made. The party agrees to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that EC can complete the party’s transactions and contact as needed. EC will bill the party through an online billing account for purchases made via the Site. Sales tax will be added to the price of purchases as deemed required by EC. EC may change prices at any time.
Refund Policy of Program
Because of the digital nature of this course, there will be no refunds.
It is the party’s responsibility to review the EC sales page and terms and conditions carefully prior to purchase, use or access to any Elemental Clarity LLC products and online courses.
The goal of the program has been communicated in marketing, such as webinars, social media, websites, and sales pages that the target audience for this program.
EC does not offer payment plans, extensions, or other forms of payment processing outside of the Kajabi site.
Site Management
EC reserves the right, but not the obligation, to: (1) monitor the Site and Products for violations of these Terms of Use; (2) take appropriate legal action against anyone who, in EC’s sole discretion, violates the law or these Terms of Use, including without limitation, reporting such user to law enforcement authorities; (3) at EC’s sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) in EC’s sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to the EC systems; and (5) otherwise manage the Site and Products in a manner designed to protect EC’s rights and property and to facilitate the proper functioning of the Site.
Limitation of Liability
In no event will EC, or EC suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by the party under this agreement during the One (1) month period prior to the cause of action. We shall have no liability for any failure or delay due to matters beyond EC’s reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
Entire Agreement
These terms and conditions and any document expressly referred to in them constitute the whole agreement between Elemental Clarity and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement.
You, the party also agree to and have read the Elemental Clarity LLC Privacy Policy.
